Mr Mwansa of the National Restoration Party for Unity and Prosperity (NRPUP) and first respondent in the Chinsali Central Constituency election petition, has told the Chinsali High Court that he won the seat free and fair.
Mr Mwansa was making his presentation before Chipata Resident Judge Charles Kafunda who is sitting in Chinsali to preside over the petition case.
This is in a case in which losing United Party for National Development (UPND) candidate Christopher Chiponde Mulenga has petitioned Chanda Mwansa as Chinsali MP.
Mr Mwansa denied claims that he or his supporters distributed pens and money to voters in exchange for votes, saying there was no evidence linking him to the alleged electoral malpractice.
He also denied participating in or causing violence during the election period, adding that some of the violence alleged during the proceedings was directed at NRPUP members.
“The elections were free and fair, and I did not participate in or cause any violence during the elections,” Mr Mwansa said.
A witness Violet Mtonga, a NRPUP agent told the court that she had no evidence showing that Mr Mwansa personally distributed pens or money to voters she served as an election agent and covered Mwaba, Lubwa, Choshi and Chinsali Day polling stations.
Ms Mtonga also told the court that there were few incidents of violence during the campaign period where the UPND supporter was removing campaign posters belonging to NRPUP.
Another witness, Mr Innocent Mulenga a NRPUP party official, told the court that he was not aware that Mr Mwansa was distributing pens or money to voters.
He also said that he had no knowledge of a grey Toyota Spacio allegedly used to distribute the items.
He told the court that Mr Mwansa had told them to avoid violence before, during and after elections.
Meanwhile, Harrison Phiri, a businessman and executive officer at delight radio station told the court that his radio station issued disclaimers before hosting political discussions, stating that the views expressed during such discussions did not represent the position of the radio station.
He said radio stations were required to operate in accordance with IBA rules and ethical guidelines, adding that the station had never breached those requirements.
He said the station had not received any communication from the Independent Broadcasting Authority (IBA) indicating that it had breached broadcasting regulations or relating to violence.
Mr Phiri further told the court that media houses which failed to comply with IBA regulations and ethical requirements have been suspended.
Meanwhile, Electoral Commission of Zambia (ECZ) Presiding Officer Kingsley Kabengele told the court that the election results were recorded on the prescribed GEN 20 forms and that the results announced were correct.
Mr Kabengele said the ECZ had not received written reports confirming allegations of violence at polling stations.
He further told the court that some election diaries containing relevant information were sent to Lusaka and had not been produced before court.
“The results announced were the correct results, and the Commission did not receive any written report confirming that there was violence at the polling stations,” Mr Kabengele said.
The court also heard that failure by polling agents or stakeholders to sign GEN 20 forms does not, on its own, invalidate election results.
The court has since set October 16 and 29, 2026 for parties to file their written submissions before judgement is delivered.
