The Chinsali High Court has dismissed an application to stop payment of legal costs pending appeal.
In the case, Victor Mbeleshi had asked the court to suspend its earlier ruling which dismissed his petition against the Shiwang’andu parliamentary election results that declared Stephen Kampyongo as winner.
Judge Lombe had dismissed the petition with costs due to failure to follow proper procedure.
In his application, Mbeleshi argued that enforcing the ruling would affect his chances of a successful appeal.
But in his ruling on 5th October, Judge Lombe said the petitioner failed to explain how being required to pay costs would stop his appeal from succeeding.
He said the claim that the case should be paused to protect both sides was not supported by evidence.
The judge ruled that Mbeleshi did not provide sufficient grounds to stop the execution of the costs order.
He has since dismissed the application and ordered Mbeleshi to pay the costs of the application to the respondents.
